What it is
California has more leave than any other state. The hard part is that it comes in pieces with four-letter names.
Two things keep your job. Pregnancy Disability Leave (PDL) covers the time you are disabled by pregnancy and birth, up to four months per pregnancy, at any employer with five or more employees. The California Family Rights Act (CFRA) gives 12 more weeks to bond with the baby, also at employers with five or more, if you have worked there a year and 1,250 hours. The federal FMLA gives 12 weeks at employers with 50 or more; for a birthing mother it runs at the same time as PDL, so it rarely adds time. The California Civil Rights Department (CRD) and the U.S. Department of Labor enforce these.
Two things pay you. State Disability Insurance (SDI) pays part of your wages while you are on PDL, usually four weeks before the due date and six to eight weeks after. Paid Family Leave (PFL) pays eight weeks for bonding in the baby's first year. Both come from the Employment Development Department (EDD). Neither protects your job on its own.
What's typical
A common stack for a mother who qualifies for everything: SDI starts four weeks before the due date and runs six weeks after a vaginal birth or eight after a cesarean. Then CFRA bonding starts, with PFL paying eight of those 12 weeks. That is roughly five to six months off, most of it with some pay.
SDI and PFL pay a percentage of recent wages, since 2025 set at 70 to 90 percent depending on income, up to a weekly cap. Check the current EDD figures for your year.
What's known
Legal Aid at Work publishes a chart of how these fit. The common mistakes: assuming FMLA adds 12 weeks on top of PDL and CFRA for the mother (it does not); not knowing CFRA bonding comes after PDL, as separate time (it does); and assuming PFL protects your job (only CFRA or FMLA do). Employers under five employees are outside PDL and CFRA, but their workers still get SDI and PFL pay.
What helps
- Write your own timeline on one page: due date, SDI start, CFRA start, PFL weeks, return date. Bring it to HR.
- Ask HR, in writing, which of these they think apply to you, and keep the reply.
- If HR's answer does not match this map, call Legal Aid at Work's free helpline before you agree to anything.
When to call someone
- Nowyou are told you will be fired, demoted, or replaced for taking leave. Note who said it and when, and call the CRD or Legal Aid at Work.
- Todayyour employer refuses to give you PDL forms, or says you must quit to take time off.
- At your next visitask your provider when they will sign the SDI certification and when the disability period starts.
